Conscientious objection of the Spanish notaries on the occasion of the new law of voluntary jurisdiction

dc.descriptionThe Spanish Non-Contentious Proceedings Act of 2015 enables notaries to instruct the previous record of capacity and to celebrate civil marriages, also of same sex couples. Given the obligation of the notary to act at the request of individuals, this professional may be forced against his/her conscience in performing these marriages. This article assesses the feasibility of Spanish notaries' conscientious objection to same sex marriages, as well as the moral permissibility of their cooperation in evil. Regulatory elements examined play against the recognition of conscientious objection, that might well have been admitted without substantial detriment of the objective of the reform of marriage in the Spanish legal system. The research verifies the lack of legal protection suffered by the freedom of conscience of the notary.en
dc.descriptionLa Ley de Jurisdicción Voluntaria española de 2015 habilita a los notarios para que instruyan el acta previa de capacidad y celebren matrimonios civiles, también de personas del mismo sexo. Dada la obligación del notario de actuar a petición de los particulares, este profesional podría verse forzado en contra de su conciencia respecto de esos matrimonios. La presente investigación tiene por objeto valorar la viabilidad del ejercicio del derecho de objeción de conciencia de los notarios españoles, así como la licitud moral de su cooperación al mal. Los elementos normativos examinados juegan en contra del reconocimiento de la objeción de conciencia del notario, que bien podría haberse admitido sin detrimento sustancial del objetivo perseguido por la reforma del matrimonio en el ordenamiento jurídico español. La investigación constata la desprotección jurídica que sufre la libertad de conciencia del notario.es
