dc.descriptionEn este trabajo se analiza la figura de la legitimación activa en el proceso en referencia al recurso de protección en el ordenamiento chileno. Se parte de una aproximación conceptual y dogmática general, diferenciando la legitimación activa de otros conceptos procesales que a veces se toman como equivalentes. Posteriormente, se estudia el contenido de la legitimación activa en el marco de la acción de protección, sobre la base de las precisiones de la Corte Suprema respecto del perjudicado concreto y el tercero que acciona por otro en representación. Se examina también la intervención de asociaciones y entidades, en términos generales y con especial análisis en el ámbito del derecho a vivir en un medioambiente libre de contaminación. El estudio incluye también una revisión jurisprudencial sobre la posición de la Corte Suprema a la hora de estimar la legitimación activa de asociaciones y otras entidades en defensa del medioambiente, entre la expansión y la restricción.es
dc.descriptionThis paper analyzes the concept of active standing in legal proceedings with reference to the recurso de protección within the Chilean legal system. It begins with a general conceptual and dogmatic approach, distinguishing active standing from other procedural notions that are sometimes considered equivalent. It then examines the scope of active standing in the context of constitutional protection actions, based on the Chilean Supreme Court’s clarification regarding the directly affected party and third parties acting in a representative capacity. The role of associations and organizations is also addressed, both in general terms and with particular attention to the right to live in an environment free from pollution. The study further includes a review of case law concerning the Supreme Court’s position on recognizing the active standing of associations and other entities in environmental protection cases, oscillating between expansion and restriction.en
