dc.descriptionEl presente trabajo analiza el reconocimiento jurisprudencial de la función social como límite al derecho de propiedad, a propósito de la sentencia dictada por la Corte de Apelaciones de Rancagua el 4 de junio de 2024, en la causa Rol Civil Nº 574-2023. En dicho fallo, el tribunal confirmó la decisión de primera instancia y rechazó la reclamación interpuesta contra la Resolución Exenta Nº 523 de 2019 de la Secretaría Regional Ministerial -SEREMI- de Bienes Nacionales de la Región de O'Higgins, que complementó la Resolución Exenta Nº 5 de 1984, permitiendo el acceso vehicular -y no solo peatonal- a la playa colindante con el predio de la reclamante.es
dc.descriptionThis paper analyzes the judicial recognition of the social function as a limit to the right of property, with reference to the judgment delivered by the Court of Appeals of Rancagua on June 4, 2024, in Civil Case No. 574-2023. In that decision, the court upheld the ruling of the court of first instance and rejected the claim filed against Exempt Resolution No. 523 of 2019, issued by the Regional Ministerial Secretariat (SEREMI) of National Assets of the O'Higgins Region, which complemented Exempt Resolution No. 5 of 1984, thereby authorizing vehicular access -and not only pedestrian access- to the beach adjacent to the claimant’s property.en
