dc.descriptionThis comment makes a criticism of the labor jurisprudence related to the termination of the work contract of the non-teaching staff of the municipal sector governed by Law N° 19.464, for health reasons incompatible with the performance of the position. Specifically, the ruling issued by the 2° Labor Court of Santiago, in the case of Rit T-786-2016, and the rulings of the Court of Appeals of Santiago and the Supreme Court of Justice, which ruled about the case under study.en
dc.descriptionEl presente comentario efectúa una crítica a la jurisprudencia laboral relacionada con la terminación del contrato de trabajo del personal no docente del sector municipal regido por la ley N° 19.464, por razones de salud incompatibles con el desempeño del cargo. Específicamente se estudia el fallo dictado por el 2.° Juzgado de Letras del Trabajo de Santiago, en la causa Rit T-786-2016, y las sentencias de la Corte de Apelaciones de Santiago y de la Corte Suprema de Justicia, que se pronunciaron sobre el caso objeto de estudio.es
