dc.description
This paper analyzes the phenomenon of company succession, in particular the applicable assumptions for its origin. First, the notion of company is developed with a view to determining which dimension of it can be the object of a transfer between entrepreneurs. Then, the complex concept of ownership of a company is addressed, which may have different manifestations (dominion, possession or mere holding), and which is closely related to the quality of the entrepreneur. Finally, the figure of partial succession is examined, especially the elements required for its configuration. This article is carried out from the perspective of chilean labor law, without prejudice to the developments present in other labor laws in order to reach more elements of judgment that better illustrate the issue under study.
eng
